1. Acceptance

By registering on or using the BIDSTONE platform, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the platform.

2. Registration & Deposits

You must register for each auction before bidding. Some auctions require a refundable deposit: where a deposit applies, you must pay it and be approved by BIDSTONE before you can place bids. Deposits of unsuccessful bidders are refunded in full after the auction closes. Winning bidders' deposits are refunded once their invoice has been paid in full.

3. Bidding

All bids placed on BIDSTONE are legally binding and cannot be retracted. Bids must meet the minimum bid and bid increment displayed on each lot. Bids placed in the final minutes of a lot may automatically extend that lot's closing time (anti-sniping). By placing a bid, you enter into a contract to purchase the lot at your bid price plus the applicable buyer's premium and, where indicated, VAT, if your bid is the winning bid.

4. Payment

Invoices are generated and emailed automatically when lots close. Winning bidders must pay their invoice within 48 hours. Failure to pay may result in account suspension, forfeiture of any deposit, and the lot being re-listed. Payment is via EFT to BIDSTONE's nominated bank account.

5. Fees & VAT

A buyer's premium is added to the winning bid price. Lots marked as VAT applicable attract VAT at 15% on the hammer price, shown on the lot and itemised on the invoice. Seller commission is deducted from seller proceeds. Rates are displayed on the invoice and may be updated by BIDSTONE from time to time.

6. Collection

Items must be collected within the collection window specified for each auction. Collection details are provided only after payment is confirmed. BIDSTONE is not responsible for items not collected within the specified period.

7. Item Condition

All lots are sold voetstoots (as-is, where-is). Descriptions and photographs are provided as a guide only and do not constitute a warranty or representation of any kind. By bidding, you confirm that you have satisfied yourself as to the nature, condition and quality of the lot. No returns or refunds are given on account of condition, except where required by law.

8. Seller Obligations

Sellers warrant that they have the right to sell the items submitted and that descriptions are accurate. Sellers must deliver items as described once approved.

9. Communications

BIDSTONE sends transactional emails necessary to operate the platform (such as invoices, outbid notices and winner notifications). By registering for an auction, submitting an item, or signing up on the website, you consent to receive auction announcements by email. Every announcement contains an unsubscribe link, and you may withdraw this consent at any time. Transactional emails are not affected by unsubscribing.

10. Disputes

BIDSTONE's decision on all auction matters is final. Disputes must be raised within 24 hours of auction close. BIDSTONE is not liable for any consequential or indirect losses.

11. Governing Law

These terms are governed by the laws of the Republic of South Africa.
